1. Who this policy covers
This policy is issued by SMJ Consulting Group LLC, a Connecticut limited liability company doing business as theBuildd ("theBuildd," "we," "us"). It applies to thebuildd.com and to the lead generation and dispatching services described in our Terms of Service.
Two different groups give us information, and we treat them differently:
- Contractors who visit this site, request a call, or buy a plan.
- Homeowners who opt in through our advertising to be contacted about work at their property.
Sections 5 and 6 set out what is specific to each group. We are the controller of the information described here. Where we deliver a homeowner's details to a contractor, that contractor becomes independently responsible for what it does with them.
2. Information we collect
Information you type into our contact form. Our enquiry form asks for your full name, business name, phone number, email address, website, trade, preferred qualification and handoff option, and anything you add in the message field. Name, phone, email and trade are required; the rest are optional.
Your agreement record. When you tick the box agreeing to our Terms of Service, we record that you ticked it, the date and time you did, the version of the Terms you accepted, and the IP address the submission came from. Terms Section 7 explains why: if a charge is later disputed, that record is the evidence that the agreement was accepted. We do not use it for advertising.
Homeowner opt-in details. Through our advertising, homeowners give their name, contact details, property location and a description of the work they want. Section 5 explains what happens to that information.
Technical information. Our host and network provider, Cloudflare, processes standard request data such as IP address, browser type and the pages requested, in order to serve and protect the site.
What we do not collect. This website runs no analytics product, no advertising pixel and no third-party tracking script. We do not sell personal information, and we do not collect payment card details on this website; card processing is handled by Stripe under its own terms.
3. How we use information
We use contractor information to reply to your enquiry, discuss trade and ZIP-code coverage, quote and administer a plan, take payment, provide support, keep the acceptance and billing records our Terms require, and meet our legal and tax obligations.
We use homeowner information to contact the homeowner about the enquiry they submitted, to attempt the qualifying conversation where the Order includes Dispatching, and to deliver the lead to the single contractor entitled to receive it.
We also use aggregated, non-identifying information to understand which campaigns produce workable enquiries. This does not identify any individual.
We do not sell personal information, and we do not share it for cross-context behavioural advertising.
5. Homeowners who opt in
If you asked to be contacted about work at your property, you opted in through one of our advertisements or landing pages. Here is what that means in practice.
Your details are delivered to one contractor for your trade and area. That contractor is a separate, independent business. It is responsible for its own calls, texts and emails to you, for honouring your opt-out requests, and for its own privacy practices and the work it performs. theBuildd does not perform, supervise or guarantee any contractor's work.
Where the contractor's plan includes Dispatching, our own call team may contact you first to confirm the details of your request before passing you to the contractor.
You can ask us to stop contacting you, to tell you which contractor received your enquiry, or to delete your details, using the contact points in Section 13. If a contractor already holds your details, you will also need to ask that contractor directly, and we will tell you who it was so that you can.
6. Contractors who buy leads
Leads are licensed to your business only. Terms Section 8 prohibits reselling, sharing or transferring them, and requires you to protect homeowners' personal information and use it only to respond to their enquiry.
You are solely responsible for making your own calls, texts and emails comply with the Telephone Consumer Protection Act, the Telemarketing Sales Rule, CAN-SPAM, and state telemarketing and do-not-call rules, and for honouring every opt-out request immediately. We recommend you maintain your own privacy notice covering what you do with the homeowner details we deliver.
8. How long we keep information
We keep enquiry and account records for as long as you are a client and afterwards for as long as we need them to meet tax, accounting and legal obligations and to defend potential claims. Terms Section 11 sets a one-year limit for bringing a claim, and tax rules generally require longer, so billing and acceptance records are normally kept for at least seven years.
Homeowner lead records are kept for the period needed to administer delivery, duplicate checking and the replacement policy in Terms Section 5, and then deleted or de-identified.
9. Your choices and rights
Depending on where you live, you may have the right to ask us for a copy of the personal information we hold about you, to correct it, to delete it, to limit how we use it, or to appeal a decision we make on such a request. Connecticut, California and several other states provide rights of this kind.
To make a request, email legal@thebuildd.com. We will verify your identity before acting, respond within the period the applicable law allows, and will not treat you differently for asking. If we decline, we will explain why and how to appeal.
To stop marketing email from us, use the unsubscribe link in the message or email us. Requests that concern a contractor's own calls or emails to you must also be made to that contractor.
10. Security
We use the access controls and encryption in transit provided by the services described in Section 4, and we limit access to enquiry records to the people who need them. No method of transmission or storage is completely secure, so we cannot guarantee absolute security. Please do not send sensitive information, such as financial account or government identification numbers, through the website form.
11. Children
This website and our services are directed to businesses and to adult homeowners. They are not directed to children, and we do not knowingly collect personal information from anyone under 18. If you believe a child has given us information, contact us and we will delete it.
12. Changes to this policy
We may update this policy by posting a new version on thebuildd.com and changing the "Last updated" date above. Material changes affecting active clients will also be notified by email, consistent with Terms Section 12.
